In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

Background:The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students.Objectives:To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain.Research design:A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat room platform. A thematic, inductive (...) analysis was performed of the information gathered.Participants and research context:Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic.Ethical considerations:The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos.Results:Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions.Conclusions:These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. According to some authors, Latour’s attention to politics during the last decades is the result of his proposing a different approach to politics that entails, with respect to his overall project, one of two situations. Either his epistemological proposal has suffered a “normative turn”—which necessarily breaks with the previous assumptions of Actor-Network Theory (ANT); or, if ANT’s view on technosciences remains valid, his political proposal becomes not possible as a new normative approach. In this paper, I will focus on the (...) critique voiced by John Law, as well as Graham Harman. I will argue that this is a false dilemma because there has not been a change in Latour’s conceptual basis, nor a lack of coherence within his thought that would undermine the democratic commitment of his Political Epistemology. I will justify this by exposing the fact that Latour’s overall project, as part of Science Studies, has not lately followed a “political” but an “ontological” turn, which has been underling his works since the very beginning of ANT. Aphantasia is a condition that is often characterized as the impaired ability to create voluntary mental images. Aphantasia is assumed to selectively affect voluntary imagery mainly because even though aphantasics report being unable to visualize something at will, many report having visual dreams. We argue that this common characterization of aphantasia is incorrect. Studies on aphantasia are often not clear about whether they are assessing voluntary or involuntary imagery, but some studies show that several forms of involuntary imagery are also (...) affected in aphantasia (including imagery in dreams). We also raise problems for two attempts to show that involuntary images are preserved in aphantasia. In addition, we report the results of a study about afterimages in aphantasia, which suggest that these tend to be less intense in aphantasics than in controls. Involuntary imagery is often treated as a unitary kind that is either present or absent in aphantasia. We suggest that this approach is mistaken and that we should look at different types of involuntary imagery case by case. Doing so reveals no evidence of preserved involuntary imagery in aphantasia. We suggest that a broader characterization of aphantasia, as a deficit in forming mental imagery, whether voluntary or not, is more appropriate. Characterizing aphantasia as a volitional deficit is likely to lead researchers to give incorrect explanations for aphantasia, and to look for the wrong mechanisms underlying it. (shrink)

Este trabajo esboza un programa de investigación que anuda la fenomenología del cuerpo con la paleontología humana y con la antropología filosófica, a fin de examinar si y en qué medida los vínculos existentes entre la experiencia corporal, la imaginación y la memoria pueden formalizarse en términos geométricos tales como la verticalidad y, en ese sentido, constituir una base para la determinación simbólica de fenómenos orgánicos.

According to a common view, conscious thoughts necessarily involve quasi-perceptual experiences, or mental images. This is alleged to be the case not only when one entertains conscious thoughts about perceptible things, but also when one thinks about more abstract things. In the case of conscious abstract propositional thoughts, the idea is that they occur in inner speech, which is taken to involve imagery (typically auditory) of words in a natural language. I argue that unsymbolized thinking and total aphantasia cast doubt (...) on this common view. Unsymbolized thinking is the experience of thoughts that does not involve imagery. Total aphantasia is the inability to produce mental images of all sensory modalities. I consider and reject the objection that these individuals are mistaken either because their thoughts do involve images, or because those thoughts are not conscious. Thus, unsymbolized thinking and aphantasia provide evidence that conscious thoughts can occur without imagery. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

Os problemas da lei e da autoridade marcaram fortemente o pensamento políticomedieval ocidental, e em especial o desenvolvimento da noção de soberania, ponto deconvergência dos grandes conflitos de jurisdição no período. O debate acerca dadistribuição das jurisdições constituiu um dos momentos importantes para a construção damoderna idéia de soberania. Na medida em que se tomava a lei como dada, o sentido daautoridade tinha necessariamente de ser vinculado à idéia de comissão: a autoridade eraum atributo daquele que podia fazer cumprir a (...) lei em nome do legislador divino. Outromomento relevante foi o da emergência do problema do poder legislativo, tal como entendidomodernamente. Jurisdição, a partir daí, passaria a incluir também o direito de criar ede impor as normas válidas para toda a comunidade por um legislador agora humano. Aospoucos, a vontade do príncipe, que não se limita mais pelo rigor da razão e da moralidade,passa a ser entendida como fonte criadora, transformadora e revogadora da lei. O presente artigo busca articular reflexões a partir da teoria da interseccionalidade. Nesse campo, a questão da liberdade é um ponto importante e é antípoda do racismo. A forma pela qual as mulheres negras afirmam a liberdade, individual ou coletivamente, produz resultados políticos e sociais. Neste artigo buscamos analisar a percepção da liberdade no cotidiano. Foram entrevistadas mulheres negras de diferentes níveis de escolaridade, em idade reprodutiva, residentes do sudoeste baiano. A liberdade se apresenta como uma possibilidade que advém de (...) conquistas econômicas e sociais. É, nesse sentido, resultante de lutas coletivas e sociais. O racismo é, então, uma barreira importante a ser considerada a partir da teoria da interseccionalidade. A estruturação de sentidos e significados construídos nas narrativas do cotidiano pode auxiliar na compreensão das condições sociais e de vida das mulheres negras e orientar hipóteses de pesquisa e de ação política. I address the question of whether differences in color terminology cause differences in color experience in speakers of different languages. If linguistic representations directly affect color experience, then this is a case of what I call the linguistic penetrability of perception, which is a particular case of cognitive penetrability. I start with some general considerations about cognitive penetration and its alleged occurrence in the memory color effect. I then apply similar considerations to the interpretation of empirical studies of color perception (...) in speakers of different languages. I argue that findings such as differences in categorical perception in speakers of different languages do not show that language affects color experience. They therefore do not support the claim that color experience is linguistically penetrable. But even if we grant that color experience is different in speakers of different languages, I argue that this might still not be a case of linguistic penetration. Finally, I consider some epistemological consequences of the assumption that speakers of different languages have different color experiences. (shrink)

Brazil has one of the highest levels of economic disparity in the world. The educational system plays a large role in this reality, acting as a mechanism of social exclusion. Neoliberalism has resulted in the commodification of education, empowering private schools while undermining the public system. This has created a vicious cycle, whereby educational inequality reflects and reinforces social inequality. Such a system violates the rights of children not lucky enough to be born into wealth – the right to equal (...) education; to equal opportunity; and equal treatment. From within this context, we propose a model, dubbed The Eagle’s Flight, for psychological intervention in public schools. This will form an extension of our research group’s Psychosocial Assessment and Intervention – Prevention, Community and Liberation, which has been an on-going project for the past fourteen years. The intervention model advocates monitoring child development from a critical, social and historical perspective, focusing on how school and community affect everyday life. The analysis will be carried out via the daily immersion of psychologists in the public school setting, who pay attention to key aspects which include various expressions of violence, financial difficulties related to unemployment, informal employment or drug dealing, poor access to health services, and the developmental impact of factors such as poverty. Based on Paulo Freire's Emancipatory Education Proposal and Ignacio Martín-Baró’s Liberation Psychology, intervention in school and community must be an interdisciplinary procedure, employing professionals from a range of disciplines involved in the study of child development. The various subjects’ perspectives seek to provide support for everyday problems and solutions, whilst breaking down the hegemonic model of psychological practice that considers the child and family as responsible for their problems. A concrete example of this critical psychosocial intervention model is presented. (shrink)

It identifies some of the key issues that help to shape an African American socio-cultural context and explores their implications for biblical interpretation.

La pandemia producida por el COVID-19 llevó a las instituciones educativas a suspender todo tipo de actividad presencial. La educación superior pasó a desarrollarse en contextos digitales, lo que supuso un rediseño en cuanto a los recursos, instrumentos, modos, estrategias de actuación y medidas a implementar en el proceso de enseñanza-aprendizaje. En este estudio se analiza, desde una mirada cualitativa, las visiones del estudiantado sobre la docencia universitaria en contextos de pandemia. Los resultados evidencian la perspectiva diferencial del alumnado,-entusiasta, crítica, (...) condescendiente y nostálgica- sobre la educacion superior, en atención a su experiencia universitaria, vivida en contextos de profunda excepcionalidad. El artículo sugiere algunas observaciones sobre una antropología darwinista planteada a partir del conocimiento científico disponible. Al efecto, señala la importancia del estudio del genoma humano como fundamento de una reflexión filosófica de segundo grado sobre la naturaleza del ser humano, subrayando las grandes similitudes entre el Homo sapiens y las especies evolutivamente más próximas. Además, a partir del estudio del ADN mitocondrial y del cromosoma Y, centra la atención en el principio de coalescencia evolutiva entre seres humanos, gracias al (...) cual es posible afirmar que todos ellos son miembros consanguíneos de un mismo linaje. Argumentation mining aims to automatically detect, classify and structure argumentation in text. Therefore, argumentation mining is an important part of a complete argumentation analyisis, i.e. understanding the content of serial arguments, their linguistic structure, the relationship between the preceding and following arguments, recognizing the underlying conceptual beliefs, and understanding within the comprehensive coherence of the specific topic. We present different methods to aid argumentation mining, starting with plain argumentation detection and moving forward to a more structural analysis of the detected (...) argumentation. Different state-of-the-art techniques on machine learning and context free grammars are applied to solve the challenges of argumentation mining. We also highlight fundamental questions found during our research and analyse different issues for future research on argumentation mining. (shrink)

BackgroundThis pilot study aims to test the usability of the iACTwithPain platform, an online ACT-based intervention for people with chronic pain, to obtain information on which intervention and usability aspects need improvement and on expected retention rates.MethodsSeventy-three Portuguese women with chronic pain were invited to complete the first three sessions of the iACTwithPain intervention assess their quality, usefulness and the platform’s usability. Twenty-one accepted the invitation. Additionally, eight healthcare professionals working with chronic medical conditions assessed the platform and the intervention (...) from a practitioner’s point of view.ResultsThis study presented a considerable attrition rate (71.43%) among chronic pain participants, with six completers. There were no significant differences in demographic or clinical variables between dropouts and completers except for completed education (participants who dropped out presented less education than completers). Reasons for dropout were related to difficult personal events occurring during the time of the intervention, lack of time, or having forgotten. There seemed to be an overall satisfaction with both the intervention, its contents and form of presentation of information, and the platform, concerning its design, appearance, and usability. Real image videos were preferred over animations or audio by chronic pain participants. Healthcare professionals emphasized the appealing and dynamic aspects of the animation format.ConclusionThis study informs the ongoing improvement of the iACTwithPain platform and provides valuable information on aspects researchers should consider while developing online psychological interventions for chronic pain. In 1923 Rudolf Otto gathered a number of appendices in Das Heilige (1917) in one of which he connected Zen Buddhism and the medieval mystic Meister Eckhart. When, in 1965 Shizuteru Ueda published his doctoral dissertation on Eckhart, he included a comparison with Zen returning to that topic. Equality policies in Spain have increasingly developed since the creation of the National Women’s Agency (1983). Over a ten‐year period Spain has achieved European standards in equality policies in terms of institutions, budget and legitimization. In a short time Spain moved from a dictatorship to European Union membership, which has brought about enormous changes regarding women’s roles and rights. Other relevant changes concern the political organization of the state: the 1978 Constitution sets a model of regional administrative autonomy, neither centralized (...) nor federal, in which each region has developed gender institutions. Gender‐equality policies constituted the framework for the development of gay and lesbian policies. Both gender equality and gay and lesbian policies have evolved differently at the national and regional levels, with a trend of inclusiveness, more creative policies and institutions at the regional and local levels. In the meantime, the national debate has concentrated on same‐sex marriage, while sexuality is not a topic within gender equality policies. This paper argues that the progressive inclusiveness of lesbians within the equality agenda and the new intersectional perspectives, alongside gay marriage shows an evolution of Spanish citizenship models, largely influenced by the European Union context. While the very existence of global literary studies as an institutionalised field is not yet fully established, the global turn in various disciplines in the humanities and the social sciences has been gaining traction in recent years. This book aims to contribute to the field of global literary studies with a more inclusive and decentralising approach. Specifically, it responds to a double demand: the need for expanding openness to other ways of seeing the global literary space by including multiple literary (...) and cultural traditions and other interdisciplinary perspectives in the discussion, and the need for conceptual models and different case studies that will help develop a global approach in four key avenues of research: global translation flows and translation policies, the post-1989 novel as a global form, global literary environments, and a global perspective on film and cinema history. Gathering contributions from international scholars with expertise in various areas of research, the volume is structured around five target concepts: space, scale, time, connectivity, and agency. Este artigo é um mapeamento inicial dos impactos do fotojornalismo do grupo que ficou conhecido como "O Clube do Bang Bang", na África do Sul, no período de transição entre o final da política de apartheid e as primeiras eleições democráticas no país, em 1994. Qual o papel assumido pelo registro fotográfico, com o senso de realidade que impõe àquilo que apresenta, na construção da memória política sul-africana? Este trabalho toma como disparador duas situações de sala de aula em que se questiona se a imaginação como gênero do conhecimento constitui uma ameaça ou uma possibilidade potencial do desenvolvimento humano. Para tanto, estudamos o prefácio e os dois primeiros capítulos do Tratado Teológico Político, o Tratado da Reforma da Inteligência, e a Ética de Espinosa. Nesse sentido buscamos compreender as possíveis repercussões do estudo do conceito espinosano de imaginação no âmbito educacional contemporâneo.

BackgroundThe impact of a cancer diagnosis may be traumatic, depending on the psychological resources used by patients. Appropriate coping strategies are related to better adaptation to the disease, with coping flexibility, corresponding to the ability to replace ineffective coping strategies, demonstrated to be highly related with self-efficacy to handle trauma. The Perceived Ability to Cope with Trauma scale is a self-rated questionnaire that assesses the perceived ability to cope with potentially traumatic events, providing a measure of coping flexibility. The current (...) study aimed at examining the psychometric properties of the PACT Scale in Portuguese patients with breast cancer.MethodsThe study included 172 patients recently diagnosed with early breast cancer. Participants completed a Portuguese version of the PACT scale, and instruments of self-efficacy for coping with cancer, of quality of life, and of psychological distress that were used as convergent and divergent measures, thus assessing construct validity. A confirmatory factor analysis was performed to test the factor structure of the Portuguese version of PACT scale and reliabilities were examined.ResultsResults from the CFA confirmed the two-factor structure, consistent with the original Forward and Trauma focus subscales. The two subscales demonstrated high internal consistencies. Convergent and divergent validities were confirmed: the PACT scale was related to high self-efficacy to cope with cancer, to high perceived quality of life, and to low psychological distress.DiscussionOverall, the current results support and replicate the psychometric properties of the PACT scale. The scale was found to be a valid and reliable self-reported measure to assess Portuguese breast cancer patients regarding beliefs about their capabilities in managing the potentially traumatic sequelae of cancer. The PACT is a simple and brief measure of coping flexibility to trauma, with potential relevance for application in clinical and research settings. (shrink)

El proyecto del libro es definido por Krishek, valientemente, como “neo-kierkegaardiano”; este apelativo responde con cuidado a su propósito: si bien los planteamien- tos y nociones del filósofo danés son la base y el motor de la (...) reflexión, los desarrollos y conclusiones a los que llega la autora exceden por mucho la filosofía de Kierkegaard e, incluso, en ocasiones, llegan a señalar sus deficiencias o ambigüedades. On analyse l’interprétation BHK de constantes logiques sur la base d’une prise en compte systématique de Prawitz, résultant en une reformulation de l’interprétation BHK dans laquelle l’assertabilité de propositions atomiques est déterminée par des systèmes de Post. On démontre que l’interprétation BHK reformulée rend davantage de propositions assertables que la logique propositionnelle intuitionniste rend prouvable. La loi de Mints est examinée en tant qu’exemple d’une telle proposition. La logique propositionnelle intuitionniste devrait par conséquent être considérée comme étant incomplète.
